OFFICIAL Contest REGULATIONS AND RULES

NO PURCHASE NECESSARY TO ENTER OR WIN. ALL FEDERAL, STATE, AND LOCAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED. By entering the St. Lucie County Spirit Contest (the “Contest”), entrant agrees to be bound by these Official Rules. The Contest began at 8:00 a.m. (E.S.T.) on January 1, 2002 and ends at 5:00 p.m. on June 28, 2002. The Contest is sponsored by the St. Lucie County Tourist Development Council (the “Sponsor”). The prizes are provided by Kolter Resorts at PGA Village, St. Lucie County Board of County Commissioners, and The PGA of America.

1. ELIGIBILITY: The Contest is open only to persons who are 21 years or older at time of entry. Florida residents are entitled to participate in the Contest and are eligible to win the prize. The Contest is not open to employees, independent contractors, and officers of the Sponsor or the St. Lucie County Board of County Commissioners, their advertising, promotion, and marketing agencies, legal advisors, and the immediate family members and persons living in the same household of such persons. Void where prohibited by law. Federal, state and local laws apply. No substitution or transfer of prizes will be permitted. In the event of non-compliance or an unclaimed prize, alternative selections may be used.

1. HOW TO ENTER: (1) On-Line: Log onto the St. Lucie County Tourist Development Council web site http://www.visitstluciefla.com and complete and submit the entry form as indicated; (2) By Mail: Mail a 3"x5" postcard on which you have handprinted or typed the words “St. Lucie County Tourist Development Council Contest” and your name, address, telephone number and e-mail address (if you do not have an e-mail address, print or type “no e-mail address”) to: 2300 Virginia Avenue, Fort Pierce, Florida 34982; (3) By Telephone: Call 1-800-344-8443 Monday through Friday between the hours of 9:00 a.m. (E.S.T.) and 4:30 p.m. (E.S.T.) and tell the operator you wish to enter the Contest. The entrant will be asked for his name, address, telephone number and e-mail address (if available). No photocopied, mechanically reproduced or computer-generated multiple or automated entries will be accepted. (In the event of a dispute, all on-line entries will be deemed to have been submitted by the authorized and registered account holder of the e-mail account from which the entry was sent.) The Sponsor is not responsible for late, lost, delayed, damaged, misdirected, incomplete, illegible, unintelligible or postage-due entries, which will not be accepted. To be eligible, on-line entries must be received by 8:00 p.m. (E.S.T.) June 28, 2002, mailed entries must be postmarked by June 28, 2002, and telephone entries must be received by 4:30 p.m. (E.S.T.) June 28, 2002. All entries will be stored at the office of the Sponsor. All entries become the sole property of the Sponsor and will not be acknowledged or returned. All entries will become public records and subject to public disclosure in accordance with provisions of Florida law.

1. PRIZES: The Winner will be determined by a random drawing from all eligible on-line, in person and mailed entries received, to be conducted by the St. Lucie County Tourist Development Council at its office on or about July 3, 2002. The Winner will receive (a) three (3) nights accommodations for two (2) at the Kolter Resorts at PGA Village, Port St. Lucie, Florida, (b) reimbursement for airfare to Florida not to exceed a total of five hundred and 00/100 dollars ($500.00) per person, and (c) round trip transfer to and from Kolter Resorts at PGA Village, Port St. Lucie, Florida from Palm Beach International Airport for two persons. Costs of meals, greens or other resort fees, gratuities, and all other expenses not specified as part of the prize package are the sole responsibility of the Winner. The Prize has an approximate retail value of $1,540.00 (excluding reimbursement for airfare). The Sponsor reserves the right to substitute a similar prize or prizes of equal or greater value in its sole discretion. No alternative prizes, cash equivalent or other substitutions are permitted except by the Sponsor in the event of prize unavailability. The Prizes are non-transferable and non-assignable. All federal, state and/or local taxes, and other expenses associated with the acceptance and use of any prize are the sole responsibility of the Winner.

1. ODDS: Odds of winning depend on the total amount of eligible entries received.

1. WINNER NOTIFICATION/ACCEPTANCE: The Winner will be notified by e-mail, or by telephone, or by certified mail if the Winner does not have an e-mail address, on or about July 16, 2002. Return of prize notification as undeliverable may result in disqualification, and an alternate Winner may be selected. All decisions by the Sponsor in regard to the Contest are final and binding in all respects. Winner may waive the right to receive prize. In order to claim prize, Winner may be required to complete an affidavit or declaration of eligibility and/or liability and public release which must be returned within fourteen (14) days of the postmark. Failure to sign and return the affidavit and release within fourteen (14) days, or to comply with any term or condition of these Official Rules may, at the sole discretion of the Sponsor, result in Winner’s disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to an alternate Winner. Except where prohibited by law, acceptance of prize constitutes permission to use the Winner’s name, voice, hometown and/or likeness for promotional purposes without further compensation. If you would like to obtain the name of the Winner, it will posted at http://www.visitstluciefla.com and also available by sending a self-addressed stamped envelope to: St. Lucie County Tourist Development Council, 2300 Virginia Avenue, Fort Pierce, Florida 34982, after July 16, 2002.

1. PARTICIPATION: Participation in the Contest constitutes an agreement by each entrant to comply with these Official Rules. The Official Rules will be posted on the contest rules page on the St. Lucie County Tourist Development Council web site listed above throughout the term of the Contest. Decisions of the Sponsor are final and binding in all respects. The Sponsor reserves the right to cancel or modify the Contest if they determine, in their sole discretion, that fraud or technical failure has destroyed the integrity of the Contest.

1. LIMITATIONS ON LIABILITY: By entering the Contest, the entrant agrees to each of the following: (1) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or any prizes awarded, shall be resolved individually without resort to any form of class action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claims, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.

1. GENERAL RELEASE: By entering the Contest, entrants release and hold harmless the St. Lucie County Tourist Development Council, St. Lucie County Board of County Commissioners, Kolter Resorts at PGA Village, their parent, subsidiaries, affiliates, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with any Contest or with the acceptance, possession or use of any prize (including without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).

1. SPONSORS: The St. Lucie County Tourist Development Council Contest is sponsored by the St. Lucie County Tourist Development Council, whose decisions regarding the selection of the Winner and all other aspects of the Contest shall be final and binding in all respects. The Sponsor shall not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other material relating to the Contest.
